Terms of Use

1. Who you are contracting with

These Terms of Use ("Terms") are a legal agreement between you and:

By downloading, installing or using the Scale app ("the App") you agree to these Terms and to our Privacy Policy, which is incorporated by reference. If you do not agree, do not use the App.

These Terms apply to the App as distributed through the Apple App Store and are a customised end user license agreement that supplements, and where they conflict takes precedence over, Apple's standard Licensed Application End User License Agreement. Section 15 contains terms that Apple requires us to include.

2. What the App does

Scale is an AI-assisted camera utility. You take or select a photo and the App sends it to an artificial-intelligence service that returns an estimate or description. The current modes are:

• Digital Scale – estimates the weight of an object (for example jewelry, coins, spices, parcels, ingredients);
• Tape Measure – estimates length or dimensions of an object;
• Volume Meter – estimates the volume of an object or how much liquid or food a container holds;
• Calorie Counter – estimates the calorie content of food shown in the photo;
• Plant Identifier – suggests the likely species of a plant;
• Translate – reads text in a photo and translates it;
• Object Analyzer – describes the main object in the photo.

All outputs ("Results") are generated automatically by AI models from the image alone. The App does not weigh, measure or identify anything physically. We may add, change or remove modes at any time.

3. Eligibility

You must be at least 13 years old to use the App. If you are under the age of majority where you live, you may use the App only with the permission of a parent or guardian who agrees to these Terms on your behalf. By using the App you confirm that these requirements are met.

4. License

We grant you a personal, limited, non-exclusive, non-transferable, revocable license to install and use the App on Apple-branded devices that you own or control, as permitted by the App Store usage rules, for your own purposes, including in the course of your own trade, craft or profession, subject to these Terms.

You may not: copy, modify or create derivative works of the App; reverse-engineer, decompile or disassemble it except where the law expressly allows; rent, lease, lend, sell, redistribute or sublicense it; offer the App's functionality to third parties as a service; remove any proprietary notices; or use automated tools to access the App or our servers.

5. Results are estimates, not measurements

Results are provided for general information and convenience only. You acknowledge and agree that:

• Results are approximations produced by an AI model and may be wrong, sometimes substantially. Accuracy depends on the photo, lighting, angle, visible reference objects and the object itself.
• Results are not a substitute for certified scales, measuring instruments, laboratory analysis or professional advice.
• Do not rely on Results for any purpose where an error could cause financial loss, legal consequences or harm to health or safety. This includes, without limitation: buying, selling or valuing precious metals, gemstones or collectibles; postal or customs declarations; trade, tax, legal or regulatory measurements; and any dosing of medicines, supplements or other substances.
• Calorie Counter provides rough calorie estimates for general lifestyle awareness. It is not medical, dietary or nutritional advice, does not account for your health conditions, allergies or dietary needs, and must not be used to manage any medical condition, eating disorder, diabetes or weight-loss treatment. Consult a qualified professional for such purposes.
• Plant Identifier may misidentify plants, including toxic or protected species. Never eat, touch, use medicinally or rely on the safety of any plant based on a Result.
• Translate may be inaccurate or incomplete and is not a certified translation. Do not rely on it for legal, medical, financial or official documents.
• Tape Measure, Volume Meter and Object Analyzer Results are approximate and must not be used for construction, engineering, safety or purchasing decisions without independent verification. Never use Volume Meter to measure medicines, infant formula, alcohol or any other substance where the amount matters for health or safety.

We do not review Results before they are shown to you. The App will tell you when content is AI-generated. You can report a wrong or inappropriate Result from the result screen; reports help us improve, but we do not promise to answer or correct each one.

6. Your photos and content

You keep all rights in the photos and other content you submit ("User Content"). You grant us a worldwide, non-exclusive, royalty-free license to host, copy, transmit and process User Content, and to share it with the service providers named in our Privacy Policy, solely for the purpose of producing the Results you request. We do not keep your photos on our servers after the Result has been delivered, we do not use User Content to train AI models, and we do not publish or distribute it to other users. The App keeps your Results with a small thumbnail of each photo in History on your device, where you can delete them.

Messages and result reports you send us are used to answer you and to improve the App, as described in our Privacy Policy.

You represent that you own or have the rights to submit your User Content, and that it does not infringe anyone's rights or contain material that is illegal or that depicts people without their consent.

7. Acceptable use

You agree not to use the App:

• for any unlawful purpose or in violation of any applicable law, including laws on controlled substances, weapons, wildlife, customs or consumer protection;
• to facilitate the manufacture, sale, purchase or distribution of illegal drugs or other controlled substances, or of any goods whose sale is prohibited where you are;
• to submit content that is illegal, infringing, sexually explicit, violent, hateful, harassing, or that depicts minors in any inappropriate way;
• to submit images of people for the purpose of estimating their body weight or other characteristics; the App is designed for objects, food, plants and text;
• to interfere with, overload, probe or gain unauthorised access to our servers or third-party services, or to extract or misuse our API keys or backend endpoints;
• to circumvent free-usage limits, subscription requirements or feature flags, including by manipulating device identifiers or purchases;
• to make Results available to third parties in a way that suggests they are certified, verified or produced by us with any guarantee.

We may suspend or block access from devices that violate these rules.

8. Free usage and subscriptions

Free credits. The App includes a limited number of free analyses, replenished on a schedule shown in the App. We may change the number of free credits, how they accrue, and which features are free or premium at any time. Free credits have no monetary value and cannot be transferred or refunded.

Scale Pro. Premium features are available through auto-renewable subscriptions purchased through Apple's in-app purchase system. Plans currently offered are weekly, monthly and yearly, some with a free trial or introductory price. The exact price, duration, trial length and renewal terms are shown on the purchase screen before you buy and in your Apple Account settings.

• Payment is charged to your Apple Account at confirmation of purchase or, if a free trial is offered, at the end of the trial unless you cancel at least 24 hours before it ends.
• Subscriptions renew automatically for the same period and price unless cancelled at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the end of the current period.
• You can manage or cancel subscriptions at any time in iOS Settings → Apple Account → Subscriptions. Deleting the App or deleting your data does not cancel a subscription.
• Any unused portion of a free trial is forfeited when you purchase a subscription.
• Prices may vary by country and may change. If we increase the price of an existing subscription, Apple will notify you in advance and, where required, ask for your consent before the new price applies.
• Purchases are made from Apple, which is the merchant of record. Refunds, including statutory withdrawal rights in the EU, UK and elsewhere, are handled by Apple at reportaproblem.apple.com under Apple's policies. We cannot issue refunds directly.
• If you purchase a subscription, you accept that access to the digital content begins immediately and that, to the extent Apple's terms so provide and the law allows, any right of withdrawal may be affected once the service has started.

9. Intellectual property

The App, including its software, design, text, graphics, prompts, models of interaction, trademarks and logos, is owned by Gunaydin App Studio or its licensors and is protected by copyright, trademark and other laws. Except for the license in Section 4 and your rights in your User Content, no rights are granted to you. "Scale", "AI Scale" and the Scale logo are trademarks of Gunaydin App Studio. Apple, App Store and iOS are trademarks of Apple Inc.

10. Third-party services

The App relies on third-party services (AI model providers, hosting, analytics, subscription management and notification providers) listed in our Privacy Policy. Their availability is outside our control and their terms may apply to the processing of your data. We may change providers without notice.

11. Availability and changes

We may modify, suspend or discontinue the App or any feature, mode, AI model or free-usage allowance at any time. We will try to give reasonable notice of changes that materially reduce a paid subscription's functionality, and you may cancel through Apple. We do not guarantee uninterrupted, error-free or timely operation; the App needs an internet connection and depends on third-party services.

12. Disclaimer of warranties

To the fullest extent permitted by applicable law, the App and all Results are provided "as is" and "as available" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, non-infringement and uninterrupted operation.

If you are a consumer, nothing in these Terms limits the statutory warranties and remedies that apply under the mandatory law of your country of residence, including the conformity rules for digital content and services in the EU and UK and the Turkish Consumer Protection Law No. 6502.

13. Limitation of liability

To the fullest extent permitted by applicable law:

• we are not liable for any loss or damage arising from reliance on a Result, including financial loss from valuing, buying or selling goods, health consequences of dietary or plant-related decisions, or errors in translations or measurements;
• we are not liable for indirect, incidental, special, consequential or punitive damages, loss of profits, revenue, data or goodwill;
• our total liability to you for all claims relating to the App in any 12-month period is limited to the greater of (a) the amounts you paid to us through the App in that period and (b) EUR 50.

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, for gross negligence or wilful misconduct, or for any other liability that cannot be excluded under the law of your country of residence. Where the law of your country does not allow the exclusions above, they apply only to the extent permitted.

14. Indemnity

If you are using the App for business purposes, you agree to indemnify Gunaydin App Studio and its officers, employees and contractors against third-party claims, losses and reasonable legal costs arising from your breach of these Terms or your unlawful use of the App or Results. This clause does not apply to consumers to the extent that consumer-protection law in your country prohibits it.

15. Apple-specific terms

These provisions are required by Apple and apply to your use of the App obtained from the App Store:

• These Terms are between you and Gunaydin App Studio only, not Apple. Gunaydin App Studio, not Apple, is solely responsible for the App and its content.
• Apple has no obligation to provide maintenance or support for the App.
• If the App fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price of the App (if any) to you. To the maximum extent permitted by law, Apple has no other warranty obligation regarding the App.
• Gunaydin App Studio, not Apple, is responsible for addressing any claims by you or a third party relating to the App or your use of it, including product-liability claims, claims that the App fails to conform to legal or regulatory requirements, and consumer-protection or similar claims.
• If a third party claims that the App infringes its intellectual-property rights, Gunaydin App Studio, not Apple, is responsible for the investigation, defence, settlement and discharge of that claim.
• You represent that you are not located in a country subject to a US government embargo or designated as a "terrorist supporting" country, and that you are not on any US government list of prohibited or restricted parties.
• Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
• Your use of the App must also comply with the App Store Terms of Service.

16. Deleting your data and termination

You may stop using the App at any time. Settings → Delete Account in the App deletes any photo copies still held from earlier versions of the App and the messages you sent through the App's contact form, erases your History, discards your device identifier and unlinks the device from our analytics and notification services, as described in the Privacy Policy. It does not cancel subscriptions, which you manage through Apple.

We may suspend or terminate your access, with notice where practicable, if you materially breach these Terms, if required by law, or if we discontinue the App. Sections 5, 6 (as to content already processed), 9, 12, 13, 14, 15 and 17 survive termination.

17. Governing law and disputes

These Terms are governed by the laws of the Republic of Turkey. Disputes will be brought before the courts of Istanbul (Çağlayan) and the Turkish consumer arbitration committees where applicable.

If you are a consumer residing in the European Union, the United Kingdom, Switzerland or another country whose law grants you mandatory protections, you also benefit from those protections and may bring proceedings before the courts of your own country of residence; nothing in this section deprives you of them. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

18. Changes to these Terms

We may update these Terms. The current version is always available at the link inside the App. For material changes we will notify you in the App or by notification at least 15 days before they take effect. If you do not agree to a change, stop using the App and cancel any subscription before the change takes effect; continued use after that date means you accept the updated Terms.

19. General

If any provision of these Terms is held invalid, the rest remains in force. Our failure to enforce a right is not a waiver. You may not assign these Terms; we may assign them to a successor of our business. These Terms and the Privacy Policy are the entire agreement between you and us regarding the App. Where a translation of these Terms conflicts with the English version, the English version prevails, except where the law of your country requires otherwise.
